Access to legal information is fundamental to access to justice. Yet accessibility refers not only to making legal documents available to the public, but also rendering legal information comprehensible to them. A vexing problem in bringing legal information to the public is how to turn formal legal documents such as legislation and judgments, which are often highly technical, to easily navigable and comprehensible knowledge to those without legal education. In this study, we formulate a three-step approach for bringing legal knowledge (...) to laypersons, tackling the issues of navigability and comprehensibility. First, we translate selected sections of the law into snippets (called CLIC-pages), each being a small piece of article that focuses on explaining certain technical legal concept in layperson’s terms. Second, we construct a Legal Question Bank, which is a collection of legal questions whose answers can be found in the CLIC-pages. Third, we design an interactive CLIC Recommender. Given a user’s verbal description of a legal situation that requires a legal solution, CRec interprets the user’s input and shortlists questions from the question bank that are most likely relevant to the given legal situation and recommends their corresponding CLIC pages where relevant legal knowledge can be found. In this paper we focus on the technical aspects of creating an LQB. We show how large-scale pre-trained language models, such as GPT-3, can be used to generate legal questions. We compare machine-generated questions against human-composed questions and find that MGQs are more scalable, cost-effective, and more diversified, while HCQs are more precise. We also show a prototype of CRec and illustrate through an example how our 3-step approach effectively brings relevant legal knowledge to the public. (shrink)

Though 2023 marks the sixtieth anniversary of Dr. Martin Luther King Jr.’s iconic “I Have a Dream” speech, my reflections on the theme of the 2023 annual meeting of the Society of Christian Ethics, “Vision, Imagination, and Dreams in the Work of Ethics,” are inspired by King’s lesser known “Beyond Vietnam” speech. I connect my hopes for the future of Christian ethics to King’s still unrealized vision of social transformation. It is one where the US (and other empires) would affirm—not (...) subvert—each people’s right to self-determination and we scholar-activists would continue to search for connections between and among social issues even if others insist upon their discreteness. BY EXPLORING THE ONGOING CONTROVERSY WHETHER TEACHER-LED recitation of the Pledge of Allegiance in public schools is constitutional, this paper demonstrates how and why Christians have much to gain from reverting the pledge to its pre-1954 text. I expose critical weaknesses in recent strategies to retain the contested words "under God" in the pledge employed by litigants, amici curiae, several Supreme Court justices, and other interested parties. I additionally interrogate the prominent place the American flag holds in public life and (...) question whether such preoccupation rises to the level of fetishism or even idolatry. Finally, I conclude that pacifists and others who are critical of America's expanding military empire have good reason to reject the Pledge of Allegiance entirely, whether or not the nation is described as being "under God.". THE OCCASION FOR THE ESSAYS RESPONDING TO MANAGING DIVERSITY IN academe follows in response to a challenge issued by Miguel De La Torre in a 2006 plenary panel regarding the invisibility of minority scholars' work in SCE publications. That 2006 panel, which included presentations by De La Torre, Melanie Harris, Gabriel Salgado, and Darryl Trimiew, stimulated discussions in both the Women's Caucus and the meeting of the Board of Directors; this set of essays from a 2008 plenary session and a (...) concurrent session held later in the meeting is the result of those earlier discussions. The two sessions both address diversity: these essays feature minority voices presenting specific proposals for how minority scholarship should and should not be used by majority and other minority scholars; the concurrent session featured a discussion by majority scholars on what whites must do to diversify the society. Our hope is that these essays and the discussions they generate will shed more light on this extremely complex and important issue for the SCE and the institutions in which members work. (shrink)

Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Bioethicists have long been concerned that seriously ill patients entering early phase (‘phase I’) treatment trials are motivated by therapeutic benefit even though the likelihood of benefit is low. In spite of these concerns, consent forms for phase I studies involving seriously ill patients generally employ indeterminate benefit statements rather than unambiguous statements of unlikely benefit. This seeming mismatch between attitudes and actions suggests a need to better understand research ethics committee members’ attitudes toward communication of potential benefits and risks (...) of early phase studies to potential subjects. We surveyed the members of two U.S. research ethics committees using a phase I gene transfer study scenario, and compared the results to a previous survey of potential subjects’ perceptions and attitudes toward benefit and risk for the same protocol. The results show that there is indeed a gap between the subjects’ perceptions and the committee members’ views on what is appropriate to be communicated to research subjects. This discrepancy is the product of both the commonly assumed optimism of the subjects and to a “protective pessimism” of the research ethics committee members. We discuss this discrepancy using “frameworks of trust” and demonstrate the need to incorporate these frameworks into the existing model of informed consent. (shrink)

I argue that one of the central concepts of the second part of Being and Time – resoluteness (Entschlossenheit) – represents a new way of doing philosophy and should therefore be understood as a philosophical method. Resoluteness is a specific way of comporting oneself towards things and is methodologically necessary to uncover these things as what they are. I draw on insights from the recently published On My Own Publications, in which Heidegger points to resoluteness as a crucial step towards (...) his later methodological stance. In doing so, I illuminate important aspects of Being and Time and contribute to ongoing debates about Heidegger’s philosophical method. I demonstrate that it is Heidegger’s critique of transcendental philosophy and of the inquiry into possibility conditions that is meant to be overcome by developing the idea of resoluteness as a philosophical method. We must, however, distinguish between a final causality, one directed towards reaching a specific goal, and a causality which works mechanically without reference to a goal.A final or teleological treatment is applicable to inanimate nature as well, and is by many philosophers and physicists so applied. This method of interpretation can in the inorganic realm be applied to any stage of a process. _Purpose_ of the article is to find out the main content and ways of embodying freedom as a value of the volunteer movement in the context of analyzing the social motivation of human behavior in general. _Theoretical basis._ The theoretical basis of the research is the philosophical and anthropological understanding of freedom as a person’s creative overcoming of obstacles to establish his or her eccentric essence. Such a vision is embedded, in particular, in Karl Jaspers’ philosophy of existence, Helmuth (...) Plessner’s philosophy of positioning in the world, and Paul Ricœur’s philosophy of rational choice of life path. _Originality__._ The importance of freedom as a value, as well as other social values, is revealed and specified through the analysis of the values of the volunteer movement. In the desire of people engaged in volunteer work to achieve freedom through other values, the content of freedom as a basis for self-reproduction of the individual, community and society is revealed. _Conclusions._ Representatives of various humanities and social sciences have distinct research interests in analyzing the values inherent in volunteers. As members of a certain society and certain communities in this society, volunteers do not act outside the economy, politics and other spheres of public life, but reveal their freedom through creative and non-standard solutions to economic, political, and other problems. At the same time, research psychologists focus attention on the personal self-realization of a person, theorists and practitioners of social work study volunteers’ desire to gain recognition from peers and other small social groups, and representatives of sociology, political science and other social sciences focus their attention on such socially significant values of volunteering as patriotism, solidarity, etc. The task of social philosophy is to justify the desire to contribute to the public good, which is common to all volunteers. Representatives of philosophical anthropology look for the best social intentions inherent in a person as a member of society in volunteering. Analysis of the values of volunteering as a motivator of human behavior provides knowledge of socially significant values inherent in every member of society to a greater or lesser extent. (shrink)

In his paper "Finitism", W.W. Tait maintains that the chief difficulty for everyone who wishes to understand Hilbert's conception of finitist mathematics is this: to specify the sense of the provability of general statements about the natural numbers without presupposing infinite totalities. Tait further argues that all finitist reasoning is essentially primitive recursive. In this paper, we attempt to show that his thesis "The finitist functions are precisely the primitive recursive functions" is disputable and that another, likewise defended by him, (...) is untenable. It has been divided into two parts. The first was published on May 15, 1930. The second was June 3, (...) 1930. The subject of reflection is the problem of “partisanism,” which is considered from two perspectives — metaphysical and social. The first one makes “partisanism” a manifestation of compensation, falsification of one’s being and lack of acceptance for one’s own vocation. The second one indicates that “partisanism” is a historical phenomenon, the beginning of which is the nineteenth century. Then, for the first time, society is understood as a permanent and eternal struggle. This requires as a consequence the constitution of fighting groups, called parties. Ortega, on the other hand, wants to overcome both versions of “partisanism.” Therefore, it is on the side of the authenticity of our individual life and independent of the party, ideas, feelings and values. Farmers of the Peruvian Andesmake use of seed-size variation as a source offlexibility in the production of ``nativecommercial'' farmer varieties of Andeanpotatoes and ulluco. In a case study of easternCuzco, the use of varied sizes of seed tubers isfound to underpin versatile farm strategiessuited to partial commercialization (combinedwith on-farm consumption and the next season'sseed). Use of seed-size variation also providesadaptation to diverse soil-moistureenvironments. The importance and widespread useof seed-size variation among farmers isdemonstrated in the emphasis and consistency oflinguistic expressions about (...) this trait. Smalland small-medium seed is typically sown in thecommunity's ``Hill'' unit of sub-humid,upper-elevation agriculture. Seed tubers ofmedium-size and larger are needed fordrought-stressed locales in lower-elevationlandscape units. Farm-level preferences for theseed-size of tubers also suggest potentialrelations to resource endowments of farmhouseholds and gender-related management,although these tendencies were notstatistically significant in the study. Anintra-varietal, landscape-environmentalperspective on seed-size management, whichincludes an emphasis on within-fieldversatility, helps to strengthen the researchsupport of local seed production in policiesand programs aiming for in situagrobiodiversity conservation, marketingcapacity, and food security. In the 1950s and 1960s, the search for the mechanism of oxidative phosphorylation by biochemists paralleled the description of mitochondrial form by George Palade and Fritiof Sjöstrand using electron microscopy. This paper explores the extent to which biochemists studying oxidative phosphorylation took mitochondrial form into account in the formulation of hypotheses, design of experiments, and interpretation of results. By examining experimental approaches employed by the biochemists studying oxidative phosphorylation, and their interactions with Palade, I suggest that use of mitochondrial form (...) as a guide to experimentation and interpretation varied considerably among investigators. Most notably, Peter Mitchell, whose chemiosmotic hypothesis was ultimately the basis of the correct mechanism of oxidative phosphorylation, incorporated crucial aspects of mitochondrial form into his model that others failed to recognize. I discuss these historical observations in terms of the background and training of the biochemists, as well as a proposed heuristic of form, whose use may increase the possibility that biologically meaningful molecular mechanisms will be discovered. Background: Financial conflict of interest in clinical research is an area of active debate. While data exist on the perspectives and roles of academic institutions, investigators, industry sponsors, and scientific journals, little is known about the perspectives of potential research participants.Methods: The authors surveyed potential research participants over the internet, using the Harris Interactive Chronic Illness Database. A potential research participant was defined by: self report of diagnosis by a health care professional and willingness to participate in clinical trials. Email (...) invitations were sent to 20 205 persons with coronary artery disease, breast cancer, or depression; a total of 6363 persons were screened; of these, 86% or 5478 met inclusion criteria and completed the survey. The outcome measures were respondents’ ratings on: importance of knowing conflict of interest information, whether its disclosure ought to be required, and its effect on willingness to participate—across seven widely discussed scenarios of financial conflicts of interest .Results: Majority responded that knowing conflict of interest information was “extremely” or “very” important; a larger majority felt financial conflicts of interest should be disclosed as part of informed consent . In all seven scenarios, a majority was still willing to participate but in some scenarios a sizable minority would be wary of participation. Respondents were more wary of individual than institutional conflicts of interest. Illness group and sociodemographic factors had modest effects and did not affect the main trends.Conclusions: The prevailing practice of non-disclosure of financial conflicts of interest in clinical research appears contrary to the values of potential research participants. Vitskapleg kunnskap vert skildra som noko positivt, medan erfaringskunnskap får ei negativ omtale. Dette filosofiske essayet vil framskrive ei re-oppfatning av denne dikotomien. Målet med arbeidet er å redusere dikotomien mellom desse to kunnskapsformene og vise ei forståing som er meir jambyrdig, og som samlande kan bli kalla for lærarens levande kunnskap. Teorien om levande kunnskap (...) tar utgangpunkt i mennesket si heilskapande erkjenningsevne. Mennesket sin kognitive kapasitet inneheld både rasjonelle, etiske, emosjonelle og motoriske erkjenningar. Eit avgjørande aspekt med den levande kunnskapen er lærarens etiske- emosjonelle kunnskap og sensibilitet i tillegg til den logisk rasjonelle evna. (shrink)

Globalization offers a mix of new trajectories for agriculture, livelihoods, resource use, and environmental conservation. The papers in this issue share elements that advance our understanding of these new trajectories. The shared elements suggest an approach that places stress on: (i) the common ground of theoretical concepts (local-global interactions), methodologies (case study design), and analytical frameworks (spatio-temporal emphasis); (ii) farm-level economic diversification and the dynamics of agricultural intensification-disintensification; (iii) the pervasive role of agricultural as well as environmental institutions, organizations, and (...) governance issues; (iv) the ‹agency of nature’ that blends the roles of non-human organisms and the cultural and social practices of people both at the local scale and beyond; (v) the framing of sustainability initiatives and outcomes through the perspective of historical change; (vi)␣spatial environmental dynamics of the ‹new geographics of environmental conservation’ that impact agriculture, food production, and resource management; and (vii) successful and promising policies, projects, and developments mapping out possible spaces of hope for agricultural sustainability, aquitable development, and food security. The adoption and application of these elements is successful also in avoiding the tendency toward just-so accounts or overly simplified stories of agrarian and environment successes amid the often grim realities of globalization and its impacts. This essay is an attempt to participate in a discussion about metaphysics today. I claim that metaphysic now seems silenced or taken for granted. Machiavelli’s idea of fortuna or fate represents question and perception that cannot be recognized empirically. My aim is to place Machiavelli into an ongoing discussion about the distinction between nature and culture and perception of reality as organic or harmonic. As part of this, I will discuss fortuna’s place in modern research based teacher education, which places (...) our fate in the hand of science, the institutionalization of learning and the lack of virtue. In conclusion, I wish to express some critical remarks on this development, not taking into account the metaphysical speculation. (shrink)

The main object of this article is to contribute to a clearer use of the concept reflection. The question is whether reflection has become an overexposed and diluted medicine in educational thinking. To answer this question I will examine how reflection is understood and what direction and theoretical foundation the concept is based on. The article is a Habermas inspired interpretation of basic textbooks for teacher education. In the textbooks, reflection is presented as a good medicine for the professional teacher (...) and a continuous reflection will improve the professional practice by developing consciousness in action. In the conclusion I will present some recommendations on how to improve the understanding and use of reflection. My main goal is to provide reflection with a theoretical content and a clearer direction. Reflection is a knowledge searching, which is not based on experience and facts, but which is closely tied to philosophical thinking, critical theory and the ability to develop an overview. (shrink)

The purpose of this paper is to reflect on how the Corona pandemic might influence human understanding of our position of being in the world. In the first part of the paper, we present how a pandemic can be under- stood in relation to our society and our educational system. Then, we will present problems and questions highlighted by the pandemic and the kind of transformations needed to address these problems. The core ele- ments that require transformation are the understanding (...) of the essence of man or the human condition, the understanding of what caring for nature and even a pandemic means, and how to measure human action and values. This paper offers an alternative view of spacetime different from both substantivalism and relationism. Using basic ideas underlying the fiber bundle formulation of field theories, it illustrates the function of spacetime in individuating local fields. As the system of numerical identities for entities that we can individually refer to, spacetime is an intrinsic, indispensable, and inalienable structure of the physical world with distinct entities.
